These Terms and Conditions (“Terms”) are an agreement between you and Sun Coast Spotlight (“we”, “us”, “our”). They apply to your use of suncoastspotlight.com (the “Website”) and to the shared postcard advertising we sell (the “Service”). By using the Website, submitting a request, or reserving or paying for advertising, you agree to these Terms and to our Privacy Policy. If you are accepting for a business, you confirm that you have authority to bind it. If you do not agree, do not use the Website or the Service.
1. Our service
We design, print and mail oversized, full-color shared postcards. Several local businesses advertise on one card, and each advertiser pays for its own ad space. Ad sizes, delivery areas, mailing dates and prices vary by campaign and are confirmed for each campaign. Information on the Website, including prices, sizes, areas and sample mailers, is for general guidance and may change.
2. Reservations, availability and prices
Submitting a request, calling or messaging us does not reserve a space. A space is reserved only when we confirm it to you in writing (for example by email or an order confirmation) and any required deposit has been received. Availability depends on the delivery area, the ad size and your business category, and is not guaranteed until confirmed. Listed prices are per ad space per mailing unless stated otherwise, and exclude any taxes that apply. We may change prices for future campaigns.
3. Payment, deposits and cancellations
The amount due, any deposit, the payment deadline, and the cancellation and refund rules for your campaign are stated in your order confirmation, and those terms apply to you in addition to these Terms. Unless your order confirmation says otherwise: payment is due by the deadline we give you; if you cancel or withdraw after we have started design, printing or production, we may keep amounts that cover the work already done and costs we cannot recover; and if we cannot run your ad for a reason within our control, we will refund what you paid for that ad. Late payments may delay or remove your ad from the mailing.
4. Your advertisement
- Materials. You are responsible for the accuracy and completeness of the business information, offers, claims, logos, images and text you give us (“Ad Content”), and for any coupon, discount or offer your ad promotes. Honor offers as advertised.
- Proofs and approval. We will send a proof before printing. Once you approve a proof, or once the approval deadline passes without changes, the ad is final and goes to print. We are not responsible for errors in Ad Content you approved or supplied. Changes after approval may be impossible or may cost extra and may move you to a later mailing.
- Permission. You promise that you own or have permission to use all Ad Content, and that it does not infringe anyone’s rights. You give us a non-exclusive, worldwide license to copy, edit, format, print and display your Ad Content to produce and mail the postcards, and to show the finished card on our website and in our marketing as an example of our work. You also give us permission to publish and share your Ad Content, business name and offer online as described in section 6, including on our Facebook page and Facebook groups, in our partner business directory and on suncoastloop.com, and as a digital copy that people can open, print and use.
- Content rules. Ads must be lawful, truthful and not misleading. We may refuse or remove any ad, including ads that are illegal, deceptive, hateful, sexually explicit, or that promote unlicensed services or regulated products, or that we reasonably believe could harm us, other advertisers or recipients. If we remove an ad before printing, we will refund what you paid for it.
- Licensing. If your business needs a license to operate or advertise (for example a contractor), you confirm that you hold it and will show your license number where the law requires.
5. Category exclusivity and placement
We aim to include only one advertiser per business category on each mailer, so a direct competitor is not on your card. We decide how categories are defined and where each ad is placed on the card. Exclusivity applies only to the mailing you purchased and the delivery area confirmed in your order. It is not a right to future mailings, and a space not paid for may be offered to others.
6. Online promotion and your offers
In addition to the mailing, we promote every advertiser online, unless your order confirmation says otherwise:
- Facebook. Each week we post the current mailers on our Facebook page and in our Facebook groups so people can open, print and use them.
- Partner business directory. Your business gets a listing in our partner business directory. The listing stays up until you ask us to remove it, and it is shown as a featured listing for three months.
- suncoastloop.com. Your deal is posted on suncoastloop.com and stays up until the expiry date you set.
We choose the wording, images and timing of posts. We do not guarantee any number of views, reach, clicks, redemptions or other response. Facebook, the groups, the directory and other websites are run by us or by third parties, may change or be unavailable, and have their own rules; we may leave out or remove content that does not follow them.
You are responsible for your offers. Honor every offer you advertise, including printed and digital copies, until the expiry date you gave us. Tell us the expiry date and any limits (for example one per customer), and tell us promptly if you need to end an offer early. We may take down a deal that has expired, is misleading or that you can no longer honor.
7. Printing, mailing and delivery
Mailing dates are estimates. Delivery is handled by the U.S. Postal Service, which we do not control, and mail may arrive at different times, be delayed, or not be delivered to every address. Household counts and delivery areas are estimates confirmed for each campaign. We are not responsible for delays or failures caused by the Postal Service, printers, weather, supply shortages, equipment failures, strikes, public emergencies or other events outside our reasonable control. If we cannot mail a campaign, we will offer a later mailing or a refund of what you paid for the affected ad.
8. No guarantee of results
Direct mail results depend on your offer, business, season, competition and area. We do not promise any number of calls, visits, sales or other results, and we do not guarantee that you will earn back your cost. Any examples or figures on the Website are illustrations, not promises.
9. Using the Website
You may use the Website for lawful business purposes only. You agree not to: submit false, misleading or someone else’s information; send spam or malicious code; try to break, overload, scrape or gain unauthorized access to the Website or its data; or use it to harm others. We may block access or remove content at any time.
The Website, its text, design, graphics, logos and software are owned by us or our licensors and protected by law. You may view and share pages for your own business evaluation, but may not copy or reuse them commercially without our written permission. Photos of locations may be licensed from third parties and are credited where required.
10. Calls, texts and electronic messages
By giving us your phone number or email, or by calling or texting us, you agree that we may contact you about your request and campaign by phone, text and email, including using automated technology for service messages. Message and data rates may apply, and you can reply STOP at any time. You agree that we may give you notices and records electronically, and that electronic signatures and approvals (including email approval of a proof) are binding.
11. Third-party links and content
The Website may link to other websites and may include content supplied by others. We do not control or endorse them and are not responsible for them. You use them at your own risk.
12. Disclaimers
To the fullest extent the law allows, the Website is provided “as is” and “as available”. We do not promise that it will be uninterrupted, error-free or free of harmful components. Except for the promises expressly made in these Terms and your order confirmation, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, customers or goodwill, arising from or related to the Website or the Service, even if we were told they were possible. Our total liability for any claim relating to a campaign is limited to the amount you paid us for the specific ad space that the claim is about. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnification
You agree to defend and indemnify us, our owners, employees and partners against claims, damages, costs and reasonable attorneys’ fees arising from your Ad Content, your offers and products, your breach of these Terms, or your violation of any law or third party’s rights.
15. Privacy
Our Privacy Policy explains how we collect and use information, and forms part of these Terms.
16. Changes
We may update the Website, the Service and these Terms from time to time. The “last updated” date shows the latest version. Changes apply from the date posted and do not change the terms of a campaign you have already confirmed, unless the law requires it. Continuing to use the Website after a change means you accept it.
17. Governing law and disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Before filing any claim, each party will try in good faith to resolve the dispute informally by contacting the other. Any claim that cannot be resolved informally must be brought in the state or federal courts located in Florida, and you consent to their jurisdiction and venue. To the extent the law allows, each party waives any right to a jury trial.
18. General
These Terms, your order confirmation and our Privacy Policy are the entire agreement between us about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, that is not a waiver of it. You may not transfer your rights under these Terms without our written consent; we may transfer ours as part of a sale or reorganization of our business.
